On May 31, 2007, FERC issued an Order rejecting the Midwest ISO’s proposal to revise its OATT and Energy Markets Tariff in order to add Schedule 10-ERO, providing for recovery of penalties that are imposed on the Midwest ISO by the Commission, NERC or a Regional Entity for violations of Reliability Standards. In the order, FERC also established a technical conference to address the issues raised by the Midwest ISO’s proposal concerning Reliability Standard compliance and enforcement in regions with non-profit ISOs or RTOs.
